LCPtracker Employee Privacy Notice
and CCPA Notice of Collection for California Employees and Applicants (this “Notice”)
LCPtracker collects and uses Personal Information for human resources, employment, benefits administration, health and safety, and other business-related purposes and to be in legal compliance.
We will not sell the personal information, including any sensitive personal information, we collect about our employees or applicants for employment or share it with third parties for cross contextual advertising.
The websites of LCPtracker, our app’s, and the SaaS applications we provide, have separate privacy policies and terms and conditions that apply to their use. Additionally, some of our third-party products and services may have separate privacy policies and terms of use that apply to their use. Any personal data collected in connection with your use of those websites or products and services are not subject to this Notice. If you are unsure how or if this Notice applies to you, please contact our General Counsel.
Below are the categories of Personal Information and Sensitive Personal Information (referred to herein together as “Personal Information”) we collect and the purposes for which we intend to use this information:
- Identifying information, such as your full name, gender, date of birth, and signature.
- Demographic data, such as race, ethnic origin, marital status, disability, and veteran or military status.
- Contact information, such as your home address, telephone numbers, email addresses, and emergency contact information.
- Dependent's or other individual's information, such as their full name, address, date of birth, and Social Security numbers (SSN).
- National identifiers, such as SSN, passport and visa information, driver’s license information, and immigration status and documentation.
- Educational and professional background, such as your work history, academic and professional qualifications, educational records, references, and interview notes.
- Employment details, such as your job title, position, hire dates, compensation, performance and disciplinary records, background check information, and vacation and sick leave records.
- Financial information, such as banking details, tax information, payroll information, and withholdings.
- Health and Safety information, such as health conditions (if relevant to your employment), physical limitations and special needs (for you or a third party) in order to provide reasonable accomodations, job restrictions, workplace illness and injury information, and health insurance Notice information.
- Information Systems (IS) information, such as certain login information, and IP addresses on the Company's information systems and networks.
- Geolocation data, such as time and physical location related to use of an internet website, using the time clock to clock in and out for work, application, device, or physical access to a Company office location.
- Sensory or surveillance information, such as COVID-19 related temperature checks and call monitoring and video surveillance.
- Photographs or voice and/or video recordings of, such as employee id’s, account profile pictures, recordings in applications such as 8x8 and Teams,and presentations by employees for third parties or other employees.
How do we collect Personal Information
- Generally, we collect personal data directly from you in circumstances where you provide personal data (during the onboarding process, for example). However, in some instances, the personal data we collect has been inferred about you based on other information you provide us, through your interactions with us, or from third parties. When we collect your personal data from third parties it is either because you have given us express consent to do so, your consent was implied by your actions (e.g., your use of a third-party employee service made available to you by us), or because you provided explicit consent to the third-party to provide the personal data to us. Where permitted or required by applicable law or regulatory requirements, we may collect personal data about you without your knowledge or consent.
LCPtracker collects Personal Information to use or disclose as appropriate to:
- Comply with all applicable laws and regulations, including those pertaining to employment, tax, benefits, worker’s compensation, disability, equal employment opportunity, and workplace safety.
- Recruit and evaluate job applicants and candidates for employment.
- Conduct background checks.
- Manage your employment relationship with us, including for:
- onboarding processes;
- timekeeping, payroll, and expense report administration;
- employee benefits administration;
- monitoring for the purposes of compliance equality and diversity requirements if they are required to be put in place;
- employee training and development requirements;
- the creation, maintenance, and security of your online employee accounts;
- reaching your emergency contacts when needed, such as when you are not reachable or are injured or ill;
- workers' compensation claims management;
- in order to operate the relationship with third-party customer and suppliers including the disclosure of relevant vetting information in line with the appropriate requirements of regulated customers to those customers, contact or professional CV details or resume, or your personal photo for identification to clients or disclosure of information to data processors for the provision of services to LCPtracker;
- employee job performance, including goals and performance reviews, promotions, discipline, and termination; and
- other human resources purposes.
- Manage and monitor employee access to company facilities, equipment, and systems.
- Conduct internal audits and workplace investigations.
- Investigate and enforce compliance with and potential breaches of Company policies and procedures.
- Engage in corporate transactions requiring review of employee records, such as for evaluating potential mergers and acquisitions of the Company.
- Maintain commercial insurance policies and coverages, including for workers' compensation and other liability insurance.
- Perform workforce analytics, data analytics, and benchmarking.
- Administer and maintain the Company's operations, including for safety purposes.
- For client marketing purposes.
- Respond to law enforcement inquiries and as required by law or applicable court order.
- Exercise or defend the legal rights of the Company and its employees, affiliates, customers, contractors, and agents.
- Other business-related purposes.
Personal Information collected by LCPtracker under this Notice is retained for the periods specified in the LCPtracker Data Retention Notice.
Apart from Personal Information relating to yourself, you may also provide us with personal data of related parties, notably your dependents and other family members, for purposes of your HR administration and management, including the administration of benefits and to contact your next-of-kin in an emergency. Before you provide such third-party personal data to us you must first inform these third parties of any such data which you intend to provide and of the processing to be carried out by us. You must ensure and secure evidence that these related parties, or their legal representatives if they are minors, have given their free and express consent that their personal data may be processed by LCPtracker and/or its affiliates and subcontractors for the purposes described in this Notice.
