Position Summary:
Attorney must be actively licensed in California, and preference will be given to candidates with additional state licenses. The attorney will work on a docket of collection defense cases, representing individual clients struggling with debt. The attorney will oversee litigation strategy and manage a small team of support staff. Position includes pursing affirmative claims for violations of state and federal consumer protection laws. The position is remote, and attorney may be in any state. Salary for the position is $100K+ with bonus potential, along with benefits, such as health, 401(k) contribution, life insurance, short term disability, paid time off, and dues and CLE reimbursement.
Essential Duties and Responsibilities:

  • Provide legal representation to individuals experiencing debt problems;
  • Analyze client circumstances, review relevant documents, and provide client with options;
  • Represent individual clients in court, review and respond to pleadings, and appear at hearings and/or trial as required;
  • Develop and maintain relationships with clients;
  • Keep clients updated on a regular basis;
  • Supervise collection of necessary client documents;
  • Perform and oversee all settlement negotiations;
  • Analyze settlement percentage trends and modify accordingly;
  • Address post settlement issues;
  • Manage support staff of legal assistant and paralegal;
  • Identify unfair debt collecting practices and file claims in response thereto; and
  • Perform other duties as required and assigned.

Qualifications:

  • Preferably 3+ years of litigation experience;
  • Must be licensed in CA plus another state preferred;
  • Must be in good standing in all states of licensure;
  • Juris Doctor with significant communication and management skills;
  • Superior analytic skills and computer proficiency; and
  • Must pass criminal background check.

Supervisory Responsibilities:
Supervises legal support staff including legal assistant, litigation paralegal and post-settlement resolution coordinator.

While performing the duties of this job, the employee is required to talk and listen. The employee frequently is required to stand, walk, and use hands to type or handle paperwork. May be required to sit for long periods of time.
Position Type/Expected Hours of Work:
There is some flexibility when selecting a start time, but the employee must be available during the “core” work hours of the selected schedule and is expected to work a 40-hour week. Occasional evening and weekend work may be required as job duties demand.
