SUMMARY 

 

Curana Health is seeking an experienced healthcare attorney to join our Legal team. As Corporate Counsel, you will play a critical role in providing legal counsel to Curana Health on a wide range of complex healthcare issues, including regulatory compliance; senior living facility contracting; payor contracting; vendor and IT contracting (including for healthcare delivery and population health tools); HIPAA/privacy support; and mergers and acquisitions. The Corporate Counsel will also work with the Chief Legal Officer and other Curana Health attorneys to meet the Legal Department’s overall goal of providing timely, actionable and responsive legal services to Curana Health’s board of directors, executive leadership, management and other stakeholders.

 

ESSENTIAL DUTIES AND RESPONSIBILITIES

 

  • Draft and negotiate medical director, facility staffing, vendor and IT, payor/provider, and other agreements.
  • Provide legal support for Curana Health’s accountable care organizations and population health programs (including MSSP, ACO REACH and GUIDE).
  • Provide legal counsel to Curana Health’s on-site clinic implementation team.
  • Provide legal counsel to leadership, management and the compliance department on federal and state regulatory requirements, including federal and state physician self-referral prohibitions, anti-kickback statute restrictions, corporate practice of medicine, practitioner licensing and APP supervision, and other restrictions and requirements.
  • Review, track, and monitor legislation and regulations that impact Curana Health’s services and operations, and provide timely analysis and summaries thereof to leadership.
  • Provide legal support for acquisitions and other transactions.
  • Develop strong working relationships with business clients, as well as legal and compliance partners.

 

KNOWLEDGE, SKILLS AND ABILITIES

 

  • Strong knowledge of the laws and regulations governing medical groups and their operations, including healthcare licensing, revenue cycle management, and fraud and abuse (e.g. the Anti-Kickback Statute and Stark Law).
  • Strong transactional and drafting skills.
  • Excellent written and verbal communication skills.
  • Superb attention to detail and organization skills, with the ability to prioritize, plan and appropriately approach workload and assigned projects to ensure completion.
  • High degree of maturity and professionalism and the ability to work in a collaborative, team environment.
  • Excellent skills in basic computer applications (i.e. Word, Excel, Outlook and PowerPoint).
  • Ability to take initiative and to exercise independent judgment; decision-making and problem-solving.
  • Strong background working with Medicare Advantage plans is a plus.

 

EDUCATION

 

Law degree from an ABA accredited law school required.

 

EXPERIENCE

 

Five (5) to seven (7) years’ experience in legal practice for healthcare providers, either as in-house or outside counsel.  Substantial experience advising medical groups is preferred.

 

LICENSE/CERTIFICATION

 

At least one state bar admission and in good standing.

 

The salary range is $130,000-$150,000 plus yearly bonus potential.  Pay is based on several factors including but not limited to education, work experience, certifications, etc. In addition to your salary, Curana Health offers benefits such as, a comprehensive benefits package, 401K, flexible PTO, paid holidays (all benefits are subject to eligibility requirements).

 

LANGUAGE SKILLS
 

Ability to read and interpret contracts, laws and regulations. Ability to write routine reports and correspondence.  Ability to speak effectively to the organization’s customers, partners and employees.

 

MATHEMATICAL SKILLS

 

Ability to add, subtract, multiply and divide in all units of measure, using whole numbers, common fractions, and decimals.  Ability to compute rate, ratio and percent, and to draw and interpret bar graphs.

 

REASONING ABILITY

 

Must possess strong problem identification and resolution skills.  Must be well organized, have excellent written and oral communication skills, and possess good judgment and planning skills. Ability to interpret a variety of data furnished in written, oral, diagram, or schedule form.  Ability to apply understanding to carry out instructions furnished in written, oral, or diagram form.  Ability to manage complications involving several variables in standardized situations.

 

WORK ENVIRONMENT AND CONDITIONS
 

Work is performed in a remote environment.  Involves frequent telephone contact with clients, clinicians, staff, vendors, consultants, and management.  Position often requires some flexibility in working hours.  Must be able to work efficiently under high pressure and effectively resolve conflicts as they arise.   

 

PHYSICAL DEMANDS
 

Work requires sitting for long periods. Occasional lifting up to 25 pounds. Requires moderate typing skills and sufficient manual dexterity to operate a keyboard, calculator, telephone, copier and such other office equipment as necessary. Normal or corrected vision to acceptable levels for common office work. Hearing must be in the acceptable range for telephone contacts. It is necessary to view and type on computer screens for variable periods of time.
